CLLB Rechtsanwälte gets money back – judgment of the Munich Regional Court
München, 20.09.2022. A player lost almost 10,000 euros in online sports betting. CLLB Rechtsanwälte got the money back for him. The Munich Regional Court ruled on September 14, 2022 that the provider of online sports betting must compensate the loss in full because its offer violated the ban on online gambling (Az.: 2 O 1795/22).
A far-reaching ban on gambling on the Internet was in force in Germany until July 1, 2021. Online sports betting also fell under this ban. The federal states had the opportunity to grant permission for online sports betting. “Without such a license, however, sports betting on the Internet was also illegal. As a result, players can claim back their losses,” says attorney István Cocron, CLLB Rechtsanwälte.
In the underlying case, the plaintiff also took part in the online sports betting of the defendant provider via a German-language website. The defendant did not have permission for their offer. Between 2014 and 2018, the plaintiff lost almost 10,000 euros in sports betting. “We have now reclaimed the money,” said lawyer Cocron.
With success. The Munich District Court ruled that the plaintiff was entitled to full compensation for his loss. Organizing and arranging public games of chance on the Internet was prohibited under Section 4 (4) of the State Treaty on Gambling. According to the LG Munich, the defendant violated this prohibition with its offer. The contracts for participation in online sports betting are therefore void, so that the defendant received the plaintiff’s bets without any legal reason. The court decided that the loss must therefore be fully compensated.
“On July 1, 2021, the ban from the State Treaty on Gaming was relaxed. However, this does not apply retrospectively and a license valid in Germany is still required for the offer of online gambling including sports betting. Many providers do not have such a license. Players therefore have a good chance of recovering the money they thought they had lost,” explains lawyer Cocron.
