There Court of Assizes of Appeal of Milan confirmed the final sentence of thelife sentence for Cesare Battisti, former group terrorist Armed proletarians for communism. Battisti was convicted of four murders committed at the end of 70's and arrested later 37 years old on the run last January in Bolivia. The judges have rejected the defense request to commute the sentence of life imprisonment to 30 years imprisonment. The judges have also established that the penalty will not prevent them from seeking benefits. The former terrorist, who has already served 6 and a half years of "presofferto", may in fact ask award permits in about 3 and a half years. The defenders have already declared: "We will do appeal to the Court of Cassation ".
The defense of Battisti had requested the reduction of the sentence to 30 years on the basis of theextradition agreement which had been painstakingly achieved between Italy is Brazil, where life imprisonment is not foreseen. But according to the judges, the Bolivian authorities "were free to expel the foreigner illegally entered in their territory and to deliver them to the authorities of the country of origin.
