An independent research institute in the field of constitutional law and democracy, the Initiative Code asked the Chief Justice of the Constitutional Court (MK), Anwar Usman resigned from his position after officially marrying the younger brother of President Jokowi, namely Idayati.
Acting Chief of the Initiative Code, Violla Reininda, believes that Anwar needs to step down in order to maintain the dignity and independence of the Constitutional Court.
“As a statesman, Chief Justice of the Constitutional Court Anwar Usman must resign from his position as Chief Justice of the Constitutional Court and Constitutional Court to avoid potential conflicts of interest,” Violla said in a statement to CNNIndonesia.comMonday (30/5).
Violla reminded Anwar Usman of the judicial code of ethics after he now has a family relationship with President Jokowi. If there is a family relationship (arbitrary), the judge is obliged to resign.
This is regulated in Article 17 paragraph (4) of Law Number 48 of 2009 concerning Judicial Power and the Application of the Principle of Impartiality in the Constitutional Court Regulation Number 09/PMK/2006 concerning the Enforcement of the Declaration of the Code of Ethics and Behavior of Constitutional Judges.
According to Violla, these provisions are closely related to checks and balances between the Court and the government. It is known that the Constitutional Court hears laws made by the government and the DPR.
“Regardless of whose leadership period the Law was passed, the facts and practice of the trial show that the President, through the ministries/agencies, has an interest in defending the Law so that the Constitutional Court does not cancel it,” said Violla.
Chief Justice of the Constitutional Court Anwar Usman married the younger brother of President Jokowi, Idayati in Solo on 26 May. A number of state officials were present, including President Jokowi.
Their marriage is in the spotlight because Anwar Usman is still the Chief Justice of the Constitutional Court.
The spokesman for the Constitutional Court (MK) Fajar Laksono explained that the marriage of Anwar Usman and Idayati was a private matter. He was reluctant to respond to public suspicions of independence going forward.
“Marriage is Mr. Anwar Usman’s personal matter, so I can’t comment too much on that,” Fajar said when contacted by CNNIndonesia.com, Tuesday (22/3).
“Including those who were asked about whether the marriage will later affect, for example, the issue of independence when adjudicating and deciding cases,” explained Fajar.
