Late Payment of Vehicle Taxes Can Get A Ticket, Here’s the Explanation

So if the vehicle owner is late in paying the vehicle tax, the STNK will die. So if the STNK dies, the police can get a ticket?

However, there are still many vehicle owners who think that paying vehicle taxes is not the domain of the police to take action.

“From a legal perspective, the death tax for motorized vehicles can be ticketed with the legal argument that it is not a death tax issue, but is related to the validity of the STNK,” said Budiyanto some time ago.

The vehicle registration certificate (STNK) should be validated every year by paying taxes every year. If not, of course the STNK becomes invalid.

“At the time of ratification, before being ratified by the officer, the owner must pay taxes and the Road Traffic Accident Fund Compulsory Contribution (SWDKLLJ) has just been ratified. The dead tax means it has not been ratified by an authorized officer,” he said.

This is regulated in Law No. 22 of 2009 concerning Road Traffic and Transportation (LLAJ) as well as derivative regulations that have been regulated both from the juridical aspect and the mechanism.

Budiyanto explained from a legal point of view regarding the prosecution of tax-dead vehicles as follows:

  1. Article 64 – Paragraph (1) that every motorized vehicle must be registered. Paragraph (2) As proof that the motorized vehicle has been registered, among others, the owner is given a STNK.
  2. Article 68 – Paragraph (1) Every motorized vehicle that is operated on the road must be equipped with a STNK and a motorized vehicle registration number.
  3. Article 70 – Paragraph (2) STNK and motorized vehicle registration number are valid for 5 (five) years, which must be requested for approval every year.
  4. Article 37 Paragraph (2) and paragraph (3) of Perkap No. 5 of 2012 concerning Registration and identification. Paragraph (2) STNK as proof of the legitimacy of the operation of Ranmor. Paragraph (3) STNK is valid for 5 years since it was first issued, extension and or registration of mutations from outside the Regident area and must be requested for approval every year.
  5. In another regulation, it is also stated in the ratification mechanism that before it is legalized, the owner must pay taxes and SWDKLLJ.

So between tax payments, SWDKLLJ, and ratification is an integral system that is inseparable in order to ensure the legitimacy or validity of STNK.

Criminal provisions for violating Article 288 paragraph (1) shall be punished with imprisonment of 2 (two) months or a fine of not more than Rp. 500,000 (five hundred thousand rupiah).
