“Death and inheritance bring much sorrow.” The last decision of the Supreme Court is in line with this German proverb OGH 2Ob86/21t 26.05.2021 on the subject foreign will. The death of a loved one is enough grief in itself that at least the deceased’s estate shouldn’t add to the trouble. However, as is well known, the “last will” of a deceased person carries a great deal of potential for disputes if they can no longer comment on it. It is therefore important that all formal requirements and other requirements for a valid will are met during your lifetime so that the settlement of the estate can go as smoothly as possible.
