Mini-tunnels: the trial again dismissed by the Bastia criminal court

It will be necessary to wait until March 8, 2023 so that finally be judged this file that drags on.

After a dismissal in February, the Bastia Criminal Court yesterday was to judge four construction business leaders, suspected of participating in an agreement that distorted competition: Dominique Antoniotti, Jean-Marc Cermolacce, Pierre Natali and Jean-Jacques Vendasi.

They were part of two groups of companies that applied in 2013 to a call for tenders from the Territorial Collectivity of Corsica for the construction of two mini-tunnels. They are suspected of having agreed to each obtain a contract, one group having won that of the mini-tunnel of Furiani and the other that of Casatorra (the CTC had subsequently canceled these public contracts and launched new calls for tenders which, in the end, were won by other companies).

The defendants dispute the facts. Their lawyers (Mes Cynthia Costa-Sigrist, Valérie Lelièvre-Castellorizos, Emmanuel Maestrini, Marc-Antoine Luca, Martine Caporossi-Paoletti and Jean-André Albertini) requested the annulment of the procedure. They argue that “the defense is entitled to a fair trial, but the prosecution is relying on documents which it considers essential but which are absent from the debate because they are not in the file. »

These are documents that a witness produced during his hearing during the investigation and which should therefore have been included in the appendices, they “have not been communicated to us because there are difficulties in finding them”, they lament.

“The investigation service communicated a CD in March but it did not contain the correct appendices. What the defense should have noticed, indicates the floor. The defense must be able to discuss it but there is no reason to order the nullity of the procedure because it is only a problem of communication of documents. »
