As at first instance, the order taken in October 2018 by the Prefect of Lot-et-Garonne at the time to withdraw the authorization to dig the lake, in Pinel-Hauterive, was considered valid.
At the hearing of January 26, 2021, before the Administrative Court of Appeal of Bordeaux, the public rapporteur ruled in favor of a rejection of the request of the promoters of Lake Caussade.
The judgment, rendered this Tuesday, February 23, confirms this version. Lake Caussade is indeed illegal since the order made in September 2018 by Patricia Willaert, prefect of Lot-et-Garonne who had initially authorized the start of work, was deemed legal.
The latter questioned his first order and in fact revoked the authorization to dig. Data that did not make farmers retreat. The lake, filled for months and which made it possible to irrigate the crops this summer, has indeed been dug.
To override the lack of prefectural authorization, the president of the Chamber of Agriculture, Serge Bousquet-Cassagne and his vice-president Patrick Franken were respectively sentenced in July 2020 to terms of nine and eight months in prison. .
The first also risks revocation of a previous suspended sentence of 4 months in prison. The second, 14 months old. Both appealed. The trial could be held on May 6, 2021.
