SAN FRANCISCO (AP) – A state appeals court has ordered a California doctor to hand over the medical records of three children for whom he has obtained medical exemptions from vaccinations.
In a ruling filed on Friday, the First District Court of Appeals informed Dr. Ron Kennedy forced the California Medical Board to go to court by refusing to hand over the documents.
The San Francisco Chronicle reports that the agency is investigating whether Kennedy "wrongly issues blanket medical exemptions from vaccinations."
The Santa Rosa doctor has argued that filing the records would hurt the patient's privacy. Attorney Michael Machat said none of the patients whose records were searched have complained about Kennedy's performance.
Brian Prystowsky, a pediatrician in Santa Rosa who is working to tighten California's vaccine regulations, said Sonoma County had become a paradise for physician-approved vaccine exemptions.
