The Government Doesn’t Always Agree, but Always Accepts the Constitutional Court’s Decision


President Joko Widodo (Jokowi) stated that the government does not always agree with the decision of the Constitutional Court (MK). However, Jokowi ensures that the government always respects and implements the Constitutional Court’s decision.

“As a state of law, we must jointly enforce the law, uphold justice for the benefit of the people and the progress of the nation. Indeed, the government does not always agree with the views of the Constitutional Court in its decisions. But the government always accepts, always respects and implements the decisions of the Constitutional Court,” he said. Jokowi in a special plenary session for the submission of the 2021 Constitutional Court report as broadcast virtual, Thursday (10/2/2022).

“Because that is what the 1945 Constitution provides, namely the Constitutional Court’s decision is final and binding. The government believes that our state life will be well organized if it is carried out based on the constitution,” Jokowi continued.

Jokowi also talked about the policies that were decided during the COVID-19 pandemic. He ensures that all policies are decided based on careful studies.

“It never crossed the government’s mind that in the name of the COVID-19 pandemic, the government deliberately took unconstitutional steps and methods, violated the procedures and values ​​of constitutional democracy,” said Jokowi.

Jokowi emphasized that government policies are always based on objective considerations. He said the policy was solely to overcome the COVID-19 pandemic crisis.

“The government ensures that all steps, all regulations, all policies have been considered and decided with factual reasons, measurable reasons, objective reasons. Based on various careful considerations to overcome the crisis, save the community, save the nation,” Jokowi said.

Jokowi’s Hope to the Constitutional Court

On that occasion, Jokowi was grateful that all state institutions had the same enthusiasm to work faster during the COVID-19 pandemic. He also expressed his appreciation to the Constitutional Court for accelerating during this crisis.

“I also appreciate giving the highest appreciation to the Constitutional Court for taking advantage of the pandemic period to accelerate transformation, adapt to technological advances and switch to digital justice as previously stated by the Chief Justice of the Constitutional Court,” said Jokowi.

Jokowi also hopes that the Constitutional Court’s decision will provide a solution to state problems. Jokowi said the Constitutional Court’s decision must always provide a sense of justice.

“The Constitutional Court’s decision is not enough to only provide legal certainty, but must also provide a sense of justice. But certainty and justice alone are not enough. Everything we decide must benefit the life of the nation and state. Give the greatest contribution to the prosperity of the people and the progress of the country. We are Indonesia,” said Jokowi.
