Dumisani Khumalo Fraud Charges Withdrawn by National Prosecuting Authority

National Director of Public Prosecutions Orders Withdrawal of Charges

National Director of Public Prosecutions Andy Mothibi has ordered the withdrawal of charges against Crime Intelligence head Lieutenant-General Dumisani Khumalo and six co-accused individuals. The National Prosecuting Authority formally directed the provisional withdrawal following detailed representations submitted by the legal counsel representing the officers, alongside an internal memorandum from the Investigating Directorate Against Corruption.

The legal fallout stems from an arrest operation in June last year, when the Investigating Directorate Against Corruption detained Khumalo and seven officers. Authorities had alleged at the time that the senior leadership colluded to appoint an inexperienced individual to a senior role within Crime Intelligence.

According to directives issued by Mothibi, the active investigation remains unfinalized, and the legal matter may not be re-enrolled without his express written approval.

Madlanga Commission Scrutinizes Flawed Investigation and Disputed Affidavits

The reversal of the prosecution follows intense scrutiny and dramatic testimony before the Madlanga Commission of Inquiry. Recent revelations during the hearings demonstrated that the state’s case was baseless and that Brigadier Dineo Mokwele, the officer whose appointment triggered the investigation, was suitably qualified for her role as an industrial engineer.

Andrea Johnson, who led the Investigating Directorate Against Corruption until recently, conceded during testimony that Mokwele met all qualification requirements. On Monday, July 27, 2026, President Cyril Ramaphosa agreed that Johnson could vacate her post with immediate effect after she requested the waiver of her three-month notice period.

Even after her exit, Johnson faced rigorous questioning concerning the foundational documents of the case. Proceedings focused heavily on a Section 27 affidavit originally filed by National Coloured Congress leader and Member of Parliament Fadiel Adams. Evidence leader Advocate Mahlape Sello SC questioned whether the version presented to the inquiry was authentic or potentially fraudulent, pointing to stark contradictions involving chief investigating officer Dylan Perumal and prosecutor Tyron Ramsamy.

“If one reads the Section 27 affidavit as it stands, then it would be [little] short of lunacy for investigators Ramsamy, the other investigating officer, and Perumal collectively to take a statement regarding the PKTT and call it a supplementary affidavit.”

Broader Repercussions for Law Enforcement and Future Proceedings

The collapse of the fraud and corruption case marks a major setback for the Investigating Directorate Against Corruption. The original June 2025 arrests are believed to have catalyzed an explosive public intervention by KwaZulu-Natal police Commissioner Nhlanhla Mkhwanazi, who alleged that criminal cartels had infiltrated judicial, political, and law enforcement structures while targeting Khumalo to shield corrupt networks from scrutiny.

NPA spokesperson Kaizer Kganyago confirmed the formal withdrawal of the charges following the defense’s legal representations and a subsequent review of the case file. While the immediate criminal charges against Khumalo and his colleagues have been provisionally withdrawn, inquiry proceedings before the Madlanga Commission are scheduled to resume on Monday, August 3, 2026, to examine further aspects of the police investigation.
