Controversial social media influencers Andrew and Tristan Tate will remain in jail in Miami for at least two more weeks as they fight extradition to the United Kingdom, where the brothers face dozens of criminal charges including rape and sex trafficking, according to federal authorities Thejournal. US magistrate judge Lauren Louis set a detention hearing for August 13 to determine whether the brothers should stay in jail or be released during an extradition process that could take months.

The Tates were not present in court and were not required to attend, having remained in custody since a brief court appearance two days following their July 18 arrest by US authorities in Miami. US attorney Alejandra Lopez stated in court that the UK has until mid-September to submit all materials to the Department of State.
Charges and Legal History
British authorities announced 38 new charges against the brothers—32 for Andrew and six for Tristan—adding to 21 combined charges they already faced, bringing the total to 59 charges detailed by Forbes. The Crown Prosecution Service seeks extradition based on evidence from police in Bedfordshire regarding allegations spanning from 2010 to 2017 involving four new accusers. Andrew Tate’s new charges include seven counts of rape, three counts of sex trafficking, three counts of assault, and 19 charges related to child and extreme pornography. Tristan Tate’s new charges include one count of sexual assault, two counts of rape, and three sex trafficking counts. An unsealed indictment detailed allegations that the Tates choked women, sometimes until they passed out, and raped them.
Previously, the brothers faced UK charges of rape, bodily harm, human trafficking, and controlling prostitution for gain involving three other accusers between 2012 and 2015. The Tates moved to Romania in 2016 and were arrested there in 2022 on human trafficking and sexual exploitation allegations, though that case stalled due to legal and procedural problems before travel restrictions were lifted last year.
Defense Strategy and Political Repercussions
Attorneys Joseph McBride and Jackie Perczek represent the Tates, arguing that the extradition attempt is politically motivated and that the brothers are innocent. Perczek argued that the Tates are not a flight risk, noting they routinely returned to Romania every month after previous accusations. McBride claimed after a hearing according to The Guardian that prosecutors possess only accusations, stating, It's just their word against our word right now.

Press secretary Karoline Leavitt flatly rejected the idea of White House intervention in the extradition process noted by The Irish Times. Meanwhile, some conservative figures and former allies have distanced themselves or remained silent following the arrests, while Representative Yassamin Ansari sent a letter to House Oversight Committee chair James Comer urging an investigation into the Tates’ ties to the Trump family.
