Novo Nordisk Sues Eli Lilly Over Alleged False Advertising
Novo Nordisk, the Danish pharmaceutical manufacturer of Wegovy and Ozempic, has filed a lawsuit in a U.S. district court in New Jersey against its primary competitor, Eli Lilly.
Allegations of Deceptive Comparative Advertising
At the center of the dispute are advertisements for Eli Lilly’s weight-loss and type-2 diabetes medications, Mounjaro and Zepbound. According to the lawsuit, Eli Lilly’s campaigns “intentionally” utilized outdated studies to compare the highest approved doses of its own products against lower doses of Novo Nordisk’s medications.
Novo Nordisk asserts that these advertisements deceptively present Eli Lilly’s products as having broad, product-level superiority while omitting critical clinical context.
The company specifically identified the comparisons of Mounjaro against Ozempic and Zepbound against Wegovy as the primary points of contention.

said John F. Kuckelman, senior vice president and group general counsel for Novo Nordisk. The company further noted that the controversial advertisements have appeared on platforms including TikTok and Facebook, as well as during recent global sporting broadcasts, which Novo Nordisk claims has caused widespread confusion among the public.
Stakes in the Weight-Loss Drug Market
The litigation highlights the intense rivalry between the two pharmaceutical giants as they compete to dominate the rapidly expanding weight-loss drug industry. Analysts estimate that the U.S. market for these treatments could be worth more than $100 billion by 2030. Both companies have developed synthetic GLP-1 receptor agonists, which mimic a hormone produced after eating to regulate appetite and are utilized for both obesity management and type-2 diabetes treatment.
The financial success of these medications has created significant revenue for both firms.
Eli Lilly’s Response and Legal Demands
Eli Lilly has rejected the allegations, stating that it stands firmly behind our advertising.
A spokesperson for Eli Lilly stated, It is truthful, it is transparent, and it is grounded in the most direct scientific evidence available – exactly what patients deserve. We will continue to focus on the science and defend against this lawsuit vigorously.
Regarding the specific studies cited in their marketing, Eli Lilly accused Novo Nordisk of attempting to prevent the company from communicating the results of a comparison trial that the U.S. firm described as robustly designed
and the gold standard.
Novo Nordisk is currently seeking a court order that would require Eli Lilly to remove the disputed advertisements and launch a corrective advertising campaign.
Furthermore, the company has stated that if Eli Lilly does not voluntarily pull the commercials, it intends to file a motion in the coming days to seek a preliminary injunction to block the advertisements from continuing to air.
