The controversy centered on remarks made by Dutch protest singer Sophie Straat during her performance at the Gentse Feesten. Before beginning her final song, Straat instructed the audience that all white men to the back should move, a comment she stated was intended to create space for individuals who are otherwise marginalized. Following public outcry, Unia launched an investigation into the incident.

Unia determined that the remarks did not violate existing antidiscrimination laws. According to Carole Poncin, a spokesperson for the agency, the context of the statement was the deciding factor in their assessment. The statement was made at the end of an artistic performance with a social and political message about inequality, Poncin explained. The agency noted that there was no evidence suggesting white men were actually prevented from attending the concert or participating in the event’s activities.

Freedom of Expression and Artistic Protection

In its ruling, Unia emphasized that artistic and political speech carries a high level of protection under the law. The agency cited jurisprudence from the European Court of Human Rights, which mandates that such expressions are protected even when they are perceived as provocative, shocking, or hurtful.
