According to an analysis published by news.metal.com (SMM), the incident has created uncertainty over whether the presence of rare earth elements affects export eligibility. Existing regulations classify alumina exports primarily by aluminum oxide purity rather than rare earth content.
Alumina Shipment Detention Highlights Regulatory Ambiguity Over Rare Earth Elements
The reported detention aligns with wider delays affecting mineral exports across ekonomi.bisnis.com. The Indonesia Nickel Industry Forum (FINI) reported that approximately 120 surveyor reports had not yet been issued, affecting cross-industry mining commodities originating from operations in Sulawesi, West Kalimantan, and Bangka Belitung. FINI General Chairperson Arif Perdana Kusumah stated that the unissued surveyor reports involve multiple surveyors, including ekonomi.bisnis.com, Anindya, Carsurin, Tribhakti, and Geo Services. Shipments of nickel pig iron and bauxite-processed products such as alumina have experienced delays in obtaining export permits due to additional testing requirements for 17 rare earth elements, uranium, and thorium.

Existing Purity Rules and Unclear Legal Framework
Indonesia’s current trade regulations separate alumina into prohibited and controlled categories based on aluminum oxide purity thresholds. Under Trade Minister Regulation No. 22/2023, as amended by No. 6/2026, smelter-grade alumina containing less than 98% aluminum oxide and chemical-grade alumina below 90% aluminum oxide are prohibited from export, subject to specified exceptions. Meanwhile, Trade Minister Regulation No. 23/2023, updated by No. 5/2026 and No. 12/2026, permits exports of alumina meeting those purity standards provided exporters obtain a surveyor report. However, the regulations do not explicitly state whether detectable rare earth element content reclassifies alumina as a rare earth product.

Customs Regulation KMK No. 20/MK/BC/2026, which took effect on April 1, 2026, provides customs authorities with an operative list of prohibited export goods and may relate to the detention, though authorities have not disclosed the inspection process or legal basis for the case. Additionally, Government Regulation No. 24/2026 establishes a broader framework for governing exports of strategic natural-resource commodities, but it currently applies exclusively to coal, palm oil, and ferroalloys. Officials have not released the cargo’s Harmonized System code, purity level, laboratory results, testing methodology, or documentation.
Industry Response and Rare Earth Downstreaming Goals
Industry stakeholders have expressed concern over the lack of published rare earth element thresholds, testing standards, and tariff classifications for alumina containing trace rare earth elements. Arif noted that while industry players support testing to map potential rare earth reserves, the presence of these elements as secondary trace components in processed products should not automatically prohibit the export of otherwise compliant primary products. Exporters have been advised to review testing procedures and seek written confirmation from appointed surveyors regarding testing methods and acceptance criteria.
Separately, the Presidential Staff Office has emphasized the development of an integrated rare earth element ecosystem to strengthen national resilience and mineral downstreaming. Dudung Abdurachman, Head of the Presidential Staff Office, stated during a coordination meeting that rare earth elements should be treated as part of the national industrial value chain rather than merely a mining activity. Indonesia holds estimated reserves of approximately 350,000 tons of rare earth oxides, which serve as essential raw materials for advanced industries including semiconductors, electric vehicles, batteries, renewable energy, and defense technologies.
