A federal judge is demanding testimony from a Justice Department attorney regarding the legal basis for the deportation of migrants under the Alien Enemies Act, and has expanded a criminal contempt probe into South Dakota Governor Kristi Noem’s involvement in the matter. The judge is seeking to determine if the flights, which transported migrants to Martha’s Vineyard last year, were lawful.

Deportation Flights Under Scrutiny

U.S. District Judge James Boasberg ordered the DOJ attorney to testify as part of the inquiry into the flights, which were chartered by Florida Governor Ron DeSantis. The legal challenge centers on whether the Alien Enemies Act, typically reserved for wartime, was properly invoked to authorize the deportations.

Boasberg has also escalated a criminal contempt investigation into Governor Noem, stating she failed to provide answers regarding her role in the flights. The judge is seeking to understand the extent of her involvement and whether she provided any state resources for the operation.

The judge’s actions follow a request from Democratic attorneys general from several states who allege the flights were politically motivated and violated the migrants’ due process rights. They argue the Alien Enemies Act does not apply in this situation.

A whistleblower from the Justice Department is also being sought for testimony. The judge believes their insights are crucial to understanding the legal reasoning behind the decision to utilize the Alien Enemies Act.
