Convicted R&B singer R. Kelly has formally requested that President Donald Trump commute his 31-year prison sentence. The request, filed through the Department of Justice, remains pending as the White House clarifies that the submission is a standard public portal application not currently being prioritized for review.

Robert Sylvester Kelly, 59, has officially petitioned the White House for a commutation of his sentence, according to records made public this week by the Office of the Pardon Attorney. As reported by the Chicago Tribune, the filing seeks to reduce the singer’s time behind bars rather than secure a full pardon. The underlying documents supporting the request have not been released to the public.

The move follows more than a year of public lobbying by Kelly’s attorney, Beau Brindley. Despite the formal nature of the filing, the White House has signaled that the request does not carry special weight. A White House official told Rolling Stone that the application was submitted via a public portal accessible to anyone.

“This appears to be a random submission through the public portal which anyone can submit an application through. The submission of a pardon request should not be interpreted to mean anything other than an individual has chosen to submit a request. The team that reviews clemency requests at the White House is not tracking this request at this time.”

Legal History and Current Incarceration

Kelly is currently serving a combined 31-year sentence for racketeering, sex trafficking, and child pornography offenses. In 2021, a jury in Brooklyn convicted him of leading a criminal enterprise that recruited minors for illegal sexual activity. The following year, a Chicago jury found him guilty of child pornography and child enticement charges. According to The Guardian, Kelly is currently held at a medium-security federal prison in Butner, North Carolina, and is not eligible for release until January 2046.

Before the formal clemency bid, Brindley attempted to secure Kelly’s release through other channels. In June 2025, the defense filed an emergency motion for bond, alleging that prison officials had orchestrated a plot to have the singer harmed by a terminally ill inmate. Brindley publicly framed these efforts as a fight against corruption, stating at the time: The only thing that can protect Mr Kelly behind the prison walls now is the fact that now the world is watching. And we will call on the courts and President Trump to help put an end to the corruption that now threatens Mr Kelly’s life.

Attorney Conduct and Pending Motions

The clemency bid runs parallel to other legal maneuvers, including a pending motion for a new trial in Chicago. In that case, Brindley has alleged that prosecutors engaged in misconduct, a claim federal authorities have dismissed as a fishing expedition that lacks merit. Assistant U.S. Attorney Caitlin Walgamuth noted in a recent filing that the defense’s allegations were vague, conclusory allegations insufficient to warrant a formal hearing.

Brindley himself is facing professional scrutiny. The Illinois Attorney Registration and Disciplinary Commission recently filed a 31-page complaint against him, alleging a pattern of misconduct that includes lying to judges and misappropriating client funds. While Brindley has denied these allegations, the complaint could potentially lead to his disbarment. When asked about the disciplinary proceedings, Brindley told the Chicago Tribune, I’m not too worried about it.

Prospects for Executive Intervention

For now, the request remains in the hands of the Office of the Pardon Attorney. As Brindley noted in his June 2025 press conference, the defense’s strategy remains focused on direct engagement: I will ask President Trump to help us, because we need him. No date has been set for any decision on the petition.
