The Iraqi Federation obliges Erbil to pay 75% of the value of the player Louay Salah’s contract

/ The Iraqi Football Association announced today, Wednesday, obligating Erbil Club to pay an amount worth 75% of the amount of the contract signed with the player Louay Salah, as it is amounts payable to the second party, while stating that its decisions are final and binding on all parties.

The Federation said in a statement received by Agency, “The Appeals Committee of the Iraqi Football Federation met, today, Wednesday, at the Federation’s headquarters, and discussed the appeal request submitted by the Erbil Sports Club, and decided to accept it from a legal standpoint since the plaintiff submitted the complaint to the Secretary.” General dated 8/17/2015, and underlined in the margin is the former union member authorized to hold the position of Assistant Secretary (Kamel Zaghir Sultan) on 8/19/2015 (Players Affairs takes necessary action).”

He continued, “After reviewing the preliminary details of the lawsuit and the approval of the Executive Office sent to the Erbil Club, it became clear that the club had contracted with the player Louay Salah Hassan for a number of none on 9/9/2013 and until the end of the 2013-2014 season and the end of the AFC Cup for an amount of (two hundred) Forty million Iraqi dinars.

The Union explained that “the contract stated in its second paragraph the mechanism for paying the contract value, as follows: The contract amount will be paid as follows:

A- Upon signing the contract, you pay 50%.

B- The beginning of the second stage: 25%.

C- At the end of the league, 25%.

Because the terms are taken into account in this contract, it is obligatory for both parties to adhere to what is stated in the terms of the aforementioned contract.”

The statement pointed out that “(Paragraph 6) of the contract stated the authority of the administrative body of the Erbil Club to make decisions (the second party shall abide by all decisions of the administrative body, and they shall be binding on the second party).”

The Federation stated that it “has the powers to make the necessary decisions regarding matters not stipulated and force majeure, and the decisions are final and binding based on the provisions of Article (44) of the Competitions Regulations, and the force majeure circumstances that the country went through in 2014 due to the war against ISIS terrorism. The Iraqi Federation issued Football Association issued its circular No. 7/1061 on June 24, 2014, ending the Premier League, and clubs paying no less than 65% and no more than 70% of the amounts of players’ contracts.

Accordingly, the committee decided, according to the statement, “to cancel the decision of the Players Affairs Committee No. (210/ Players and Coaches Affairs / 2022 on 10/5/2023), and to oblige Erbil Club to pay an amount worth 50% of the amount of the contract signed between the two parties, as they are amounts payable to the second party upon signing.” The contract dated 9/9/2013, i.e. an amount of (120,000,000) (one hundred and twenty million Iraqi dinars) based on the text of paragraph (2/a) of the contract signed between the two parties.”

It also decided to “oblige Erbil Club to pay an amount of 25% of the amount of the contract signed between the two parties, as they are amounts payable to the second party at the beginning of the second phase, and according to the contract signed between the two parties on 9/9/2013, minus an amount of 35% according to Article (44).” From the list of competitions based on the decision of the Iraqi Central Football Association No. 7/1061 on 6/24/2014, that is, an amount of (39,000,000) (thirty-nine million Iraqi dinars), and the remaining 25% of the contract value is not due to the second party because it has not completed League with the first party based on the text of paragraph (2/c) of the contract signed between the two parties.”

The Federation explained in its statement that “for all of the above, Erbil Club is obligated to pay an amount of (159,000,000) (one hundred and fifty-nine million Iraqi dinars only), from which the player Louay Salah received (125,000,000) (one hundred and twenty-five million Iraqi dinars), so the amount to be paid will be to The player Louay Salah Hassan is paid (34,000,000) (thirty-four million Iraqi dinars only) for the remainder of the value of the contract signed between the two parties.”
