Frozen accounts, mortgage…Rose Wardini at the heart of a real estate fiasco

Obstetrician-gynecologist Rose Wardini is entangled in a failed real estate deal. After receiving an advance of 325 million CFA francs from Jean-Marie Gaillaguet, a retiree living in Ngaparou, for the sale of her apartment located on the Corniche-Ouest, she had to repay the amount plus interest. Negotiations between the parties having failed, it agreed to pay a total of 341 million 483 thousand 332 CFA francs.

According to Liberation, which reveals the case, Rose Wardini signed on April 13, 2021, before a notary, an acknowledgment of debt where she undertakes to repay the amount due before December 31, 2021 and according to well-defined terms.

On October 5, his creditor sends him by bailiff a letter served to remind him of his obligations, certainly not respected. This letter will be followed, in January 2022, by a command to pay for failure to meet the deadline (December 31, 2021).

On August 17, 2022, Jean-Marie Gaillaguet’s lawyer requested a judicial conservatory mortgage from the Dakar High Court. The request was authorized on the 24th. It relates to the Rose Wardini building subject to land title TF 15455/Gr.

In addition, on September 2, 5 and 6, the plaintiff, via a bailiff, sent to banks where Rose Wardini would hold accounts, a Pv of precautionary seizure.

Liberation informs that following these actions, Rose Wardini deposited with the notary a bond of 250 million CFA francs with a view to the lifting of the precautionary measures taken against her. It proposes at the same time to pay the remainder (of the more than 341 million which are due) in three installments. But, according to the newspaper, his creditor rejected his offer.
