Extension of the CSP until December 31, 2022 at the latest

The terms of implementation of the CSP are set out in the agreement of January 26, 2015 relating to the professional security contract.

This agreement has been amended 5 times by amendments, the last of which dated June 28, 2021, became mandatory following its approval by the Prime Minister by decree of September 24, 2021.

This amendment n ° 5 extends the CSP, which was to end on June 30, 2021, until December 31, 2022 at the latest.

As it also modifies the CSP, it is the new modalities that will have to be applied until that date.

Modification of the assessment period for the minimum duration of unemployment insurance affiliation

To benefit from the CSP, employees must prove a certain number of days or hours of affiliation to the unemployment insurance scheme during a reference period.

The duration of affiliation to the unemployment insurance scheme required to benefit from the CSP has not been changed: employees will have to continue to prove that they have a period of affiliation at least equal to 88 days or 610 hours worked (4 months). .

On the other hand, the reference period during which the employee must prove this period of affiliation has been modified for employees under the age of 53 on the date of the end of their employment contract.

The length of membership was previously assessed during the 28 months preceding the end of the employment contract (term of notice).
It is now assessed during the 24 months preceding the end of the employment contract.

The employees affected by dismissal procedures initiated (date of the prior interview or date of presentation of the invitation letter to the first meeting of the CSE) since July 1, 2021.

The length of affiliation for employees aged at least 53 at the date of the end of their employment contract continues to be assessed during the 36 months preceding the end of the employment contract (notice period).

Clarification of the economic framework in which the termination of the contract falls in the event of membership of the CSP

Addendum n ° 5 removes the reference made in the agreement relating to the CSP to the “mutual agreement of the parties” which would be the cause of the termination of the contract.

It specifies that the employee’s membership in the CSP entails termination of the contract within the framework of the specific procedure for joining the CSP which takes place during a dismissal procedure for economic reasons.

This thus confirms the possibility of the employee accepting the CSP to subsequently contest the reason for the
dismissal and / or the order of dismissals.

Other changes impacting the CSP

Amendment n ° 5 modifies other provisions concerning the CSP: new cases allowing the duration of the CSP to be extended, amount of the professional security allowance (ASP), case of interruption of payment and duration of payment of the ‘ASP to employees who do not have 1 year of seniority when the contract is terminated.

On the other hand, it replaces the references made to the unemployment insurance regulations of April 14, 2017 in the agreement relating to the CSP by references to the unemployment insurance regulations resulting from the decree of July 26, 2019.

This has an impact on a certain number of provisions that may be of interest to the CSP: differential reclassification allowance, reclassification bonus, assistance for taking over or setting up a business, resumption of unexhausted unemployment rights or the amount of compensation for the employee accepting the CSP between its registration as a jobseeker and the end of the 21-day cooling-off period.
